Sexual Offenders and Predators: Revises provisions relating to reimbursement of specified costs by sexual predators; revises provisions relating to notification of residence of sexual predators; prohibits sexual predators from working at certain locations; specifies residency distance limitations for persons convicted of certain sexual offenses; preempts certain local ordinances & provides for repeal of such ordinances; revises provisions relating to duty of court to uphold certain laws; provides additional residency restrictions on certain offenders; prohibits loitering or prowling by persons convicted of certain sex offenses; provides additional restrictions for certain probationers or community controllee's or persons on conditional release who committed sexual offenses with minors under age of 16.

Senate Panel OKs Bill Restricting Sex Offender Residencies

​HELENA, Mont. -  A Senate panel has approved a plan to keep certain sex offenders from living near children.  One Democrat voted with the seven Republicans on the Senate Judiciary Committee to pass House Bill 219 on Tuesday.  The bill restricts high-risk sex offenders from living within 300 feet of an established day-care center, playground, park, athletic facility or any place where children live. It applies only to adult offenders who victimized kids.  Republican Rep. Jeff Essmann of Billings said his constituents have repeatedly expressed concern that known sex offenders are living near elementary schools.  Opponents say the bill would force offenders to relocate every time a family moves into their apartment building or neighboring home.  Eleven states have enacted laws restricting sex offenders from living near kids, according to information from the National Conference of State Legislatures.
